Welcome to FollowUpTxt. By accessing or using our service, you agree to be bound by these Terms of Service. Please read them carefully.

1. Service Description

FollowUpTxt is an automated follow-up platform designed for independent contractors. Our service sends text message follow-ups to your clients on your behalf, based on estimates you upload to the platform. We use AI to generate personalized follow-up messages and schedule them according to your preferences.

2. Account Registration

To use FollowUpTxt, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring that your use of the service complies with all applicable laws
• Providing accurate business and contact information during onboarding

3. Acceptable Use

You agree to use FollowUpTxt only for legitimate business follow-ups related to estimates you have provided to your clients. You may not:

• Send unsolicited messages or spam through the platform
• Upload false or misleading estimate information
• Use the service to harass, threaten, or send abusive messages
• Violate any applicable federal, state, or local laws, including the Telephone Consumer Protection Act (TCPA)
• Attempt to reverse-engineer, decompile, or interfere with the platform

4. Messaging & Consent

You represent and warrant that you have obtained proper consent from your clients before adding their contact information to the platform. FollowUpTxt sends messages on your behalf, but you are solely responsible for ensuring that your clients have agreed to receive text messages from you. You must comply with all applicable messaging regulations, including TCPA requirements and any applicable state laws regarding text message communications.

By using the FollowUpTxt platform, you agree to inform each client that they will receive up to 3 automated text message follow-ups regarding their estimate. You must obtain verbal or written consent from the client before entering their phone number into the platform. The first automated message will include opt-out instructions. Message and data rates may apply.

5. Subscription & Billing

FollowUpTxt offers a free 14-day trial. After your trial period ends, you will be billed according to the plan you selected during signup. Key billing terms:

• Subscriptions automatically renew at the end of each billing cycle
• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of the current billing period
• We reserve the right to change pricing with 30 days' notice
• Refunds are handled on a case-by-case basis

6. Intellectual Property

All content, features, and functionality of the FollowUpTxt platform — including its design, code, text, graphics, and logos — are owned by FollowUpTxt and protected by copyright, trademark, and other intellectual property laws. You retain ownership of the content you upload, including estimate details and client information.

7. Limitation of Liability

To the fullest extent permitted by law, FollowUpTxt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. This includes, but is not limited to, lost profits, lost business opportunities, or damages resulting from messages sent through the platform. Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.

8. Disclaimer of Warranties

FollowUpTxt is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that messages will be delivered successfully, that the service will be uninterrupted, or that follow-ups will result in any particular business outcome.

9. Termination

We reserve the right to suspend or terminate your account at any time if you violate these terms or engage in activity that is harmful to the platform, other users, or third parties. Upon termination, your right to use the service will immediately cease, and we may delete your account data in accordance with our Privacy Policy.

10. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the “Last updated” date. Your continued use of the service after changes are posted constitutes acceptance of the revised terms.
